A MERCEDES driver has escaped a roads ban after he was caught breaking the limit in Herefordshire as it would cause "exceptional hardship".

Ian Spencer Remington appeared before Worcester magistrates for sentencing in January after entering a guilty plea to one count of exceeding a 30 miles per hour speed limit at an earlier hearing.

The court heard from the prosecutor that the 79-year-old had been caught breaking the limit behind the wheel of a Mercedes in a 30 miles per hour zone on the A40 at Weston under Penyard in Herefordshire on March 14 last year.

Remington, who is of Bridstow, Ross-on-Wye, was fined £72 and received six penalty points, with magistrates saying they had taken his guilty plea into account when deciding on the penalty.

He was also ordered to pay prosecution costs of £110 and a £34 victim surcharge, which is used to help fund services supporting victims of crime.

No totting disqualification was made as magistrates said a ban would cause exceptional hardship to Remington as he and a family member live in a rural area and need to drive to regular medical appointments, and as isolation may cause additional mental health problems.
